RUFO /Newsbreak Exactly 13 years ago today, 11 people, some of them still in their teens, met a grisly death on Commonwealth Avenue in Quezon City at the hands of cold-blooded assassins. The following day, two more were killed in mysterious circumstances, including the alleged head of the robbery gang Kuratong Baleleng. A Senate probe in the killing had concluded that the Commonwealth incident was a "rubout" and not a shootout as authorities had claimed. The probe sought to indict then Senior Supt. now Senator Panfilo Lacson and other top police officials for the crime. But 13 years since the killings, not one of the accused has spent time in jail or even arraigned, except for former Senior Supt. Michael Ray Aquino who is spending time in jail in the US for alleged violation of immigration laws and espionage. Aquino, who left the country when Estrada was ousted, was also linked to the killing of PR specialist Salvador "Bubby" Dacer and his driver. The case mirrors the present state of the human rights situation and justice system in the country: slow action on extrajudicial killings. "This is perhaps the most important case of extrajudicial killing. It has all the essential elements. We have witnesses to prove it, yet the accused are roaming free," said human rights lawyer Arno Sanidad in a news conference to mark the 13th anniversary of the massacre. No decision Sanidad and other human rights lawyers appealed to the Supreme Court to finally resolve the pending petition they filed questioning a decision of a lower court judge to dismiss the case against Lacson and other accused for lack of probable cause. The petition has been submitted for resolution two years ago but for some reason, the SC has yet to act on it. In the meantime, the pieces of evidence on the crime are slowly deteriorating and witnesses are growing impatient. " urge the SC to prioritize this case in accord with its commitment to provide judicial remedies for human rights abuses," a press statement by the private prosecutors said. "Any further delay of this case will have the effect that the SC seeks to avoid with its renewed commitment in issuing writs of amparo, habeas data and habeas corpus—state impunity and the continued rise of extrajudicial killings in the country." Shootout? The Ombudsman originally cleared all the accused in the rubout with a finding that the incident, which the police claimed was a shootout, was a legitimate operation. Due to public pressure, however, the Ombudsman modified its finding and recommended the indictment of 26 respondents, including Lacson, former Chief Supts. Francisco Zubia and Romeo Acop and former National Capital Region Command Chief Supt. Jewel Canson. The operation was led by Task Force Habagat under the defunct Presidential Anti-Crime Commission headed by then Vice-President Joseph Estrada. Six months after the incident, in Nov. 1995, murder charges were filed before the Sandiganbayan. In March 1996, the respondents challenged the jurisdiction of the Sandiganbayan , arguing that the case should be tried by a regular court. Related Stories • Bearing the Pain • She told me her story. And died • Kuratong payoff As the issue of jurisdiction was being contested, relatives of the victims were reportedly paid to file affidavits of desistance. In the meantime, President Estrada won the presidential race. Two months after Estrada assumed office, the original whistle blowers in the alleged rubout led by SPO2 Eduardo delos Reyes, recanted their statements when it appeared that the case would no longer prosper. Another witness, SPO2 Corazon de Jesus, had left the police force and opted to live in relative anonymity in the province. Following the recantation of Delos Reyes and de Jesus, Quezon City judge Wenceslao Agnir Jr. in 1999 dismissed the case for lack of probable cause. Liable for murder In March 2001, a month after Estradas ouster, PNP director-general Leandro Mendoza endorsed a new preliminary investigation on the rubout following the admission of Senior Insp. Abelardo Ramos and Insp. Ysmael Yu that they were part of the raiding team that executed the rubout. A panel of state prosecutors later found probable cause to hold Lacson and other respondents liable for 11 counts of murder. Lacson sought refuge in the Court of Appeals to stop the lower court from proceeding with the new case. The appellate court sided with Lacson, noting that the revived case is barred by the two-year prescriptive period. The CA decision was contested before the SC. In April 2003, the SC ordered the Quezon City RTC to proceed with the trial and the case was raffled to Judge Ma. Theresa Yadao. In October that same year, the prosecution filed a manifestation to amend the criminal information to reflect the minor victims Meleuren Sorronda and Sherwyn Abalora who were only in their teens at the time of the incident. The following month, Yadao dismissed the charges against Lacson et al for lack of probable cause. In March 2004, the Office of the Solicitor-General questioned Yadaos ruling before the SC. In June 2006, the SC issued an en banc resolution noting the urgent resolution filed by the private counsels for the Court to resolve the case. Since then, the SC has not acted on the case. Evidence and morale Sanidad fears the prolonged delay might affect the quality of the evidence connected with the murder. He cited for instance the van where the rubout victims were killed that is under the custody of the National Bureau of Investigation. Sanidad said it is not known how the evidence is preserved including the forensic and medico-legal report and the firearms. Further delays could also affect the morale of the new witnesses. Aside from Yu and Ramos, nine more witnesses to the crime are now in the custody of the justice departments Witness Protection Program. Four of the witnesses were among those who fired at the victims.
