Senators gave mixed reactions to the ruling of the Supreme Court , which upheld the secrecy of negotiations on the Japan-Philippines Economic Partnership Agreement under the principle of executive privilege.
Speaking at the Kapihan sa Senado, administration Sen. Juan Ponce-Enrile said the SC decision was the “correct position.”
“In shaping foreign policy, the president is supreme. She shapes it and she must be given enough flexibility, leeway and discretion to shape that foreign policy according to her best judgment of what is national interest,” he said.
With this latest boost to Malaca�±ang and JPEPA, Enrile said he expects the treaty to be ratified eventually.
“Let us ratify JPEPA. If there is any constitutional infirmity, that ought to be the function of the Supreme Court to say whether this provision is infirm or not,” he said.
Prior to the SC ruling however, an informal survey of senators showed the JPEPA falls short of the required 16 votes to ratify.
Sen. Manuel Roxas, co-sponsor of the JPEPA along with Sen. Miriam Defensor Santiago, agreed.
“This prerogative of the president must be respected especially as this involves sensitive diplomatic exchanges between two sovereign nations,” said Roxas, chair of the Senates Trade and Commerce Committee
Roxas said however that after such negotiations are over, any treaty or agreement submitted to the Senate for ratification must be made public.
Sen. Rodolfo Biazon, for his part, said the decision “strains the credibility and impartiality of the Supreme Court.”
Biazon said the Senate should take appropriate action in appealing the decision, being the treaty-ratifying arm of government.
“Ratification is a process that entails public debate. How can public debate be proper if executive privilege is invoked, denying the public certain information necessary for public acceptance of the proposed treaty or agreement? There can be no public debate if information is withheld from the public,” Biazon concluded.
