Wall St flat on global caution before quarter-end

U.S. stocks were little changed in choppy trading on Tuesday as continuing global crises kept investors cautious before the quarter's end.

The S&P 500 index has risen 4.2 percent in the first quarter as of Monday. Still, investors were reluctant to risk gains with Japan's nuclear power problems and the civil unrest in the Middle East and North Africa unresolved. Monday's trading volume was the lowest of the year.

"The quarter is ending with a lot of uncertainties out there, resulting in messy intraday moves at the same time that nothing is really happening," said Michael Shaoul, chairman of the New York-based Marketfield Asset Management, which oversees $973 million.

"There's nothing obvious about what investors need to do in this environment, and that's why you're seeing such low volume," he said. "No one has any reason to recommit capital."

After the market opened data showed U.S. consumer confidence fell in March as expectations about jobs and income growth worsened, according to a private sector group.

Home Depot Inc (HD.N) late on Monday said it would buy back $1 billion of outstanding shares through an accelerated program. Shares rose 2.2 percent to $37.47 and were the top percentage gainers on the Dow.

U.S. single-family home prices fell for the seventh straight month in January, according to the S&P/Case-Shiller composite index of 20 metropolitan areas. However, the drop was not as much as expected.

The Dow Jones industrial average (.DJI) was up 5.56 points, or 0.05 percent, at 12,203.44. The Standard & Poor's 500 Index (.SPX) was down 0.86 point, or 0.07 percent, at 1,309.33. The Nasdaq Composite Index (.IXIC) was up 6.04 points, or 0.22 percent, at 2,736.72.

Apollo Group (APOL.O) fell 6.5 percent to $39.59 after the education company said new enrollment fell 45 percent in second quarter.

Lennar Corp (LEN.N) fell 1.3 percent to $19.49 after swinging to a first-quarter profit but reporting a drop in revenue.

Wal-Mart Stores (WMT.N) will urge the U.S. Supreme Court on Tuesday to reject a case brought on behalf of female employees who allege the retailer gave women less pay and fewer promotions in the largest, class-action sex-discrimination lawsuit ever. Shares of the Dow component were 0.2 percent higher.

Hornets F West out for season with torn ACL

Hornets leading scorer David West has a torn left knee ligament and is out for the season, a development that dims New Orleans' playoff prospects.

"Obviously we are very saddened by this news," Hornets General Manager Dell Demps said after learning the results of an MRI, which revealed a torn anterior cruciate ligament. "David is the ultimate warrior and competitor, but an even better person and we know that he will bounce back in time."

West was injured Thursday night in the Hornets' 121-117 overtime win at Utah. He scored 29 points in the game before being taken off in a wheelchair holding his head and grimacing in pain after going down hard after a dunk that tied the game at 103 with 22.5 seconds left in regulation.

West started 70 games this season, averaging 18.9 points to go with 7.6 rebounds.

The Hornets, who play at Phoenix on Friday night, currently hold the seventh of eight playoff seeds in the Western Conference with nine regular-season games remaining.

"It's a tough situation for him," coach Monty Williams said before the game against the Suns. "He's one of my favorites and became more of a favorite since I've been around the team. I just hate to see a guy put all of his energy and passion into the game, and make the right play and come down and hurt himself like that and be done for the year."

But, Williams said, "he's one of the toughest guys I've been around. He and his wife Leslie, they'll get through this and we look forward to the future."

West's primary backup at power forward is Carl Landry, whom the Hornets acquired shortly before the NBA trading deadline in February in a deal with Sacramento that sent shooting guard Marcus Thornton to the Kings.

Landry started on Friday and then Williams said he would "play it by ear."

"We may play some small ball to take advantage of our quickness," the coach said.

In 13 games since the trade, Landry has averaged 9.5 points and 2.5 rebounds in 21.9 minutes. He has flourished before as a starter, averaging 18 points and 6.5 rebounds in his 28 starts to close out last season in Sacramento, after he was traded from Houston.

Entering Friday night's games, the Hornets (41-31) were only 3 1/2 games ahead of Houston, which is currently in ninth place in the West and trying to move up at least one spot to secure a playoff spot. Phoenix is only a game behind Houston and not only was hosting New Orleans on Friday night but plays the Hornets again in New Orleans on April 8.

West, who will be 31 in August, has twice been named a Western Conference All-Star, in the 2007-08 and 2008-09 seasons. Next season is the last on his current contract, and it is a player's option. That means West could choose to become a free agent this summer and may have played his last game with the Hornets, who drafted him in the first round in 2003.

West's agent, Lance Young of Octagon, said it is "too soon" to say whether West, who is due $7.53 million next season, will opt out and become a free agent.

Report: Apple iPad 2 Sold Out Abroad

Apple has not confirmed the reports, but it said recently that "demand for the next generation iPad 2 has been amazing. We are working hard to get iPad 2 into the hands of every customer who wants one as quickly as possible."

Ain the Telegraph UK said the paper had been calling Apple stores in the UK and hadn't been able to find a retail location with an iPad 2 in stock. "Country-wide, you won't get one," one Apple staffer from London's Covent Garden store told the paper.

Retail store employees are recommending that iPad-hunters reserve the device online so they can pick it up in-store when it becomes available.

Brian White, a senior research analyst with Ticonderoga Securities, found similar results. "Our checks at Apple stores in international markets highlight a continuation of the iPad 2 stock out phenomenon found in the U.S. over the past couple of weeks, however, we believe the U.S. stores received greater volume levels (i.e., per store) during the initial selling days," he said in a Monday note.

White said the iPad 2 was sold out within hours at Apple stores in Germany, the UK, Paris, Zurich, Toronto, and Barcelona.

Mobile Burnthe iPad 2 is sold out in Paris and stores in Canada.

"While competitors are still struggling to catch up with our first iPad, we've changed the game again with iPad 2," Steve Jobs, Apple's CEO, said last week in a statement. "We're experiencing amazing demand for iPad 2 in the U.S., and customers around the world have told us they can't wait to get their hands on it. We appreciate everyone's patience and we are working hard to build enough iPads for everyone."

Although Apple hasn't released initial sales numbers for the iPad 2, that information should be revealed soon; Apple's second fiscal quarter closed out over the weekend.

Strong international sales aren't much of a surprise, consideringApple sold around half a million iPad 2s the first weekend the device hit U.S. stores.

British army apologizes to troops fired by e-mail

LONDON – Britain's military apologized Tuesday for using e-mails to tell several dozen long-serving soldiers that they were being laid off.

The army said an "administrative error" meant the soldiers were not told in person that their contracts would be ended because of cutbacks.

Defense Secretary Liam Fox said he was "furious that such a situation should occur."

"This is no way to treat our armed forces personnel," he said. "I want to know how this was allowed to happen and what measures will be put in place to prevent this from happening again."

British media reported that the soldiers were 38 warrant officers with more than 20 years' service who are on rolling short-term contracts. The Sun newspaper said one received the news while serving in Afghanistan.

The army apologized for the distress caused and said the soldiers had since been spoken to by their commanding officers.

Jim Murphy, defense spokesman for the opposition Labour Party, said they had been treated in a "callous, cold-hearted, soulless" way.

The British army is shrinking by some 17,000 troops and the military is scrapping a fleet of fighter planes and an aircraft carrier as part of the government's deficit-slashing spending cuts.

Unlike music sales, interest in Grammys is up

NEW YORK – Music executives must be wondering how they can translate interest in the Grammy Awards into sales figures.

The Nielsen Co. said Sunday's telecast of the Grammys on CBS was seen by 26.7 million people, up about a million from last year and much more significantly from 2006 and 2008, when the music awards show had around 17 million viewers. For the second year in a row, the Grammys topped Fox's "American Idol" in public interest.

The Grammys are much less an awards show than a performance show, and stars such as Eminem, Katy Perry, Lady Gaga, Lady Antebellum, Cee Lo, Barbra Streisand, Bob Dylan and Arcade Fire performed on Sunday night.

Meanwhile, music sales continued to decrease in 2010, with digital purchases not making up for the drop in album sales.

Former "Friends" actor Matthew Perry attracted a healthy audience to check out his new ABC sitcom, "Mr. Sunshine," last week. The show's 10.5 million viewers was second only to "Modern Family" on ABC's schedule last week, Nielsen said.

Fox's "Chicago Code" also had a strong debut, with 9.4 million viewers on Fox last week. The Fox comedy "Traffic Light" barely got out of the garage, however, with 4.6 million viewers for its premiere.

CBS won the week handily, averaging 13.1 million viewers in prime-time (7.9 rating, 13 share). Fox averaged 9.3 million viewers (5.3, 9), ABC had 6.9 million (4.3, 7), NBC had 5.7 million (3.6, 6), the CW had 1.8 million (1.1, 2) and ION Television had 1.3 million (0.9, 1).

Among the Spanish-language networks, Univision led with an average of 3.5 million viewers (1.8 rating, 3 share). TeleFutura had 1.3 million (0.6, 1), Telemundo had 960,000 (0.5, 1) and Azteca and Estrella each had 240,000 viewers (both 0.1, 0).

NBC's "Nightly News" topped the evening newscasts with an average of 9.9 million viewers (6.4, 12). ABC's "World News" was second with 8.8 million (5.8, 11), and the "CBS Evening News" had 6.4 million viewers (4.3, 8).

A ratings point represents 1,159,000 households, or 1 percent of the nation's estimated 115.9 million TV homes. The share is the percentage of in-use televisions tuned to a given show.

For the week of Feb. 7-13, the top 10 shows, their networks and viewerships: "Grammy Awards," CBS, 26.67 million; "American Idol" (Wednesday), Fox, 24.05 million; "American Idol" (Thursday), Fox, 21.94 million; "NCIS," CBS, 20.35 million; "NCIS: Los Angeles," CBS, 17.16 million; "Two and a Half Men," CBS, 15.15 million; "The Mentalist," CBS, 14.86 million; "Criminal Minds," CBS, 13.67 million; "Modern Family," ABC, 13.16 million; "The Big Bang Theory," CBS, 12.79 million.
