Franco Calanog and civilian Avelino Nepomuceno during a drug sting operation in Makati City in July 1990. Jaylo and his co-accused have claimed the three fatalities were involved in drug trafficking. In their appeal, Jaylo, Valenzona and Habalo said they were denied their ‘substantive rights when the court convicted them even in their absence. Jaylo pointed out that the court acknowledged in its ruling that he was not notified of the date of promulgation. The Sandiganbayan, however, said the notices were individually sent to the defendants and their counsel, former Solicitor General Francisco Chavez. It said Chavez admitted that he tried but failed to locate his clients having last seen Habalo and Valenzona way back in 2002 and Jaylo in 2005. “Jaylos failure to inform the court of his change of address means that he failed to hold himself amenable to the orders and processes of this Court. This is an unmistakable arrant breach of the conditions of his bail bond one of which is that he must appear before the proper court. Simply stated, Jaylo jumped bail,” the court said.
