Moody's maintains Portugal at A3, outlook negative

Moody's credit rating for Portugal depends heavily on the country maintaining strong commitment to consolidating its finances, the rating agency said on Friday.

Moody's maintains Portugal at A3, toward the lower end of its investment grade ratings, with a negative outlook after Prime Minister Jose Socrates lost a vote on fresh austerity measures to tackle the country's debt crisis and resigned on Wednesday.

"Strong commitment to fiscal consolidation by both leading political parties is an important reason why the rating remains within the A range," Moody's said in a statement.

Rating agency Fitch downgraded Portugal to A- on Thursday, on a par with the Moody's rating and four notches into investment grade. However, Standard and Poor's cut Portugal on Friday to BBB, two notches below the others, and warned of further cuts.

Portuguese borrowing costs on 10-year debt rose above 8 percent for the first time since the launch of the euro currency in reaction to the downgrades.

Massey wins lawsuit over coal dust at W.Va. school

Jurors have rejected claims that a Massey Energy coal-loading silo built near a southern West Virginia elementary school exposed hundreds of children to possible health problems, a decision the energy giant said Friday was an important victory.

The class-action lawsuit, which began five years ago, claimed that Virginia-based Massey and a subsidiary, Goals Coal Co., had created a public nuisance by building the silo 235 feet from the school. It also demanded a court-administered medical monitoring program.

Trains pull up to the silo to fill their cars, and the plaintiffs argued that creates dust that puts children at risk for asthma and other lung ailments. But Raleigh County Circuit Court jurors sided with Massey in rejecting those claims after a nine-day trial in Beckley.

General Counsel Shane Harvey blasted the lawyers involved in the case for attacking the coal industry, accusing them of trying to sway the public with hype and publicity.

"But the jury focused on the facts," Harvey said. "We live in these communities and support our local schools and take great care to operate responsibly. Jobs depend on cases like these, and we are very pleased and grateful for the jury's thoughtful service."

The plaintiffs' attorney, Kevin Thompson, said he was disappointed in the verdict but would continue to fight the coal company on other fronts.

"My co-counsel and I have devoted the past several years to exposing Massey's environmental practices, and we think that's a just cause," he said.

Thompson and Massey are set to clash again Aug. 1 in Wheeling, where a three-judge panel will hear a class-action lawsuit that claims the coal company poisoned hundreds of wells and made people sick by pumping coal slurry into worked-out mines. The plaintiffs blame the slurry for turning their water orange, brown and black, but Massey denies any responsibility or wrongdoing.

A jury of six women deliberated the Raleigh County case, brought by Woodrow and Elva Dillon in 2005 on behalf of current and former pupils at Marsh Fork Elementary near Sundial. It accused Massey of negligence and demanded unspecified punitive damages in addition to the health-screening program.

The plaintiffs claimed the silo allowed dangerous levels of coal dust to enter the building. Massey argued there was no evidence to support those claims, and the judge had repeatedly questioned the quality of the testimony offered.

To win medical monitoring in West Virginia, plaintiffs must prove key legal elements — that they have suffered significant exposure to a proven hazard, and that the exposure increases their risk of developing serious latent diseases.

Judge Harry L. Kirkpatrick III said at a pretrial hearing that depositions given in the case failed to produce clear statements that coal dust is dangerous or that children will get sick from breathing it. During the trial, he observed that an expert witness was unable to say how much dust came from the silo.

Massey also argued that no regulators ever found that dust had gotten into the school.

The 70-year-old elementary school served as a media center during the Upper Big Branch mine disaster that killed 29 men last April, and it has been the subject of a fierce public battle for years.

Residents and anti-Massey activists have long complained about the dangers to children, not only from the silo but also from a massive dam that sits above the school and holds billions of gallons of coal slurry.

Plans for a new school in Rock Creek are now in the works.

Egypt pound hits 6-year low as European markets reopen

CAIRO (Reuters) – The Egyptian pound hit a 6-year low on Monday after banks reopened their doors to international deals, with the government facing a new test of sentiment later in the day when it seeks to sell $2.5 billion of short-term debt.

The stock exchange, whose doors have been shut since January 27, has said it will remain closed through Tuesday at least.

The pound traded as weak as 5.951 to the dollar on Monday, a new six-year low and down 0.4 percent from Sunday's close and 1.7 percent from Thursday's, as foreign investors and Egyptians placed orders to sell the currency after a week-long closure.

Egypt's London-listed stocks were, however, all in positive territory and the cost of insuring Egypt's debt fell in the five-year credit default swap market.

The pound was also looking more resilient than some people had expected. Traders said state-controlled banks seemed to be selling dollars to support the local currency.

"Things are stable. I can't say they're good, but they're not collapsing," said a trader at a Cairo-based bank. "There has been no central bank intervention. I don't think it will do so unless the pound reached 6.1 or 6.2 to the dollar."

The currency had closed at 5.855 on January 27, before the week-long closure as protests erupted against President Hosni Mubarak's rule.

Egyptian banks, which are operating reduced hours, opened at 10 a.m. (0800 GMT) and will close at 1:30 p.m.

DEBT TEST

The country also faces a test of debt market confidence on Monday when the central bank seeks to sell over 15 billion Egyptian pounds ($2.53 billion) of Treasury bills. Last week it was forced to cancel auctions.

One trader said his bank had not had received a single bid from a foreign investors for the bills, but expected local banks would have enough funds to cover the amount.

"Banks are well capitalized. So far it doesn't look so bad," he said.

Egypt's central bank said it would auction 8 billion pounds in 91-day bills, 5 billion pounds in 182-day bills and 2 billion pounds in 273-day bills for settlement date on Tuesday.

The auction "is large because they needs truckloads of money now," the trader said. "I am expecting yields of 12-13 pct" compared to 9.5 for 91-day bills and 10.5-10.6 for the longer T-bill maturities.

Dina Ahmad, emerging markets strategist at BNP Paribas in London, said: "We are currently expecting for 3-months around 11.20 percent and for 9 months around 12. I do not think there will be much international interest -- foreign investors will still be quite hesitant at this stage."

Banks said they had been having problems calculating their reserves, which made it hard for them to judge how many T-bills they should buy, another treasury dealer in Cairo said.

Banks on Sunday opened for the first time in a week to lines of customers wanting access to their accounts.

The central business district was palpably more relaxed early on Monday, with traffic police and soldiers returning smiles and much more fruit and vegetables on the stands, but there was no sign yet of progress in talks with an opposition that wants Mubarak's government to resign.

The central bank has said it was allowing bank customers to withdraw up to 50,000 Egyptian pounds in cash and the equivalent of up to $10,000 in foreign currency.

But on Monday, one customer in the upscale neighborhood of Zamalek was told by his bank that it was running out of cash and would not be able to give him the $5,000 he was asking for.

Other parts of the economy gradually began to return to normal on Sunday for the first time in a week, with ports, transport infrastructure and factories gearing up.

Egypt's biggest listed firm on the state's benchmark stock index, Orascom Construction, said it had resumed on Sunday construction work in over 50 location, which represents around 90 percent of the company's operations.

GB Auto, Egypt's biggest listed vehicle assembler, said on Monday it too had resumed operations nationwide.

Vonn to make late decision on Super G

GARMISCH-PARTENKIRCHEN, Germany (Reuters) – Holder Lindsey Vonn, still suffering from mild concussion after a crash last week, said she would make a last-minute decision on whether to race in Tuesday's world championships Super G.

The American, who has an unfortunate habit of picking up injuries before big events and was also a doubt ahead of her two medal-winning displays at the 2010 Winter Olympics, told Reuters this was the "scariest" she had felt ahead of competition.

"I'll make a decision as close to the start time as possible," said Vonn on the eve of the opening event at the world championships.

"This isn't like my other injuries," added the dominant force in women's skiing. "It's not about pain, I can't just fight through it.

"I don't have focus and concentration and that to me makes it the scariest and hardest injury I've ever had to deal with," added Vonn.

She also criticized the Super G course as too icy and described as "ridiculous" a suggestion that her pre-event injuries were a strategy.

Vonn, winner of the overall World Cup for the last three years, crashed in training last week.

She missed Friday's slalom at Zwiesel before struggling through a giant slalom on the same German course on Sunday, finishing a modest 18th.

"I had some major problems," said Vonn. "I felt pretty good until about halfway down the course, from there to the finish I just lost concentration completely.

BIG EVENTS

"I couldn't focus any more and on both runs I lost almost one second in the last 15 seconds. That's purely because of my head injury.

"Today I felt better but I'm not perfect. I'm hoping things get better for tomorrow," added Vonn.

"I don't just crash before big events, I crash all the time. It's unfortunate but it happens in ski-racing."

Vonn was a doubt for the Vancouver Olympics until the last moment because of a foot injury but went on to win gold in the downhill and bronze in the Super G.

She is also world champion in the downhill and is due to defend that title on Sunday.

"It's going to be difficult for me. If I couldn't race tomorrow it would be awful, the worst possible scenario," said Vonn.

"I want to try and defend my titles. I'm a racer, I want to race. This injury is really hard for me. There's nothing I can do but wait and just rest."

In a later news conference, she said her decision on whether or not to compete could by influenced by the course.

"It's too dangerous for the women," she said. "It's way too icy. I'm basically shocked by it, it's unbelievable."

Asked if her injuries were a strategy to lift pressure, she replied: "That's totally ridiculous. I never want to get hurt for any reason at any time.

"There are just times when you end up in the nets."
