Dear Ms. XXXXXX Carlo Parlanti was tried before a jury in Ventura County Superior Court and was convicted of forcible rape, inflicting corporal injury on a cohabitant, and false imprisonment by force or violence. On April 7, 2006, the trial court judge sentenced Parlanti to nine years in prison, including an eight-year upper term for rape, and a consecutive one-year middle term for corporal injury to a cohabitant. The three-year term for false imprisonment was stayed. Through his attorney, Parlanti appealed his conviction and his sentence to the California Department of Corrections and Rehabilitation (state prison). On appeal Parlanti contended that the trial court committed instructional and sentencing errors and that his trial counsel was ineffective, because he failed to request certain instructions. On May 2, 2007, the Court of Appeal affirmed the judgment of his convictions, but vacated his sentence, and remanded the case for resentencing. The Court of Appeal held that Parlanti was incorrectly sentenced to an upper term sentence for rape because the jury did not make the factual findings that the court used to select the upper term. On January 22, 2007, the United States Supreme Court held that a California judge may not impose an upper term sentence, because the aggravating sentencing factors to support such a sentence must be tried by a jury. Following that decision, California amended its determinate sentencing laws to comply with the United States Supreme Court’s decision. Parlanti filed a petition with the California Supreme Court seeking to have the Court of Appeal’s decision reversed and the case set for a hearing before the California Supreme Court. On July 11, 2007, the California Supreme Court denied his petition for review. On August 15, 2007, his case was ordered returned to the Ventura County Superior Court for resentencing and he was ordered transported to Ventura County so that he could be present in court for the resentencing on October 1, 2007. However, on September 28, 2007, Parlanti’s attorney waived Parlanti’s right to be present for resentencing. On October 1, 2007, the sentencing hearing was continued to October 25, 2007 and Parlanti’s attorney again waived his right to be present for the sentencing on that date. Currently, Carlo Parlanti is in custody at the Avenal State Prison, 1 King Way, P. O. Box 8, Avenal, CA 93204. Our office has received inquiries in the past asking for information about Parlanti’s medical condition. Normally, our office has no access to medical information about prison inmates. However, even if such information was provided to our office by an inmate’s attorney or from another source, we would not be permitted to share such information.
