Definitions and Interpretation
1.1 In these Rules, all capitalized words and expressions shall have the following meanings:

Account

An online Account maintained by a Customer on the Central Computer System which contains a Customer’s personal information and all other relevant details necessary to enable them to purchase a Product or add credits to their Wallet Balance, enter a draw, if they so wish, and withdraw any winnings.

AED

United Arab Emirates Dirham.

Authorized Financial Institution

Any banking organization or financial institution authorized by Emirates Draw to pay certain Prizes.

Ball Draw Machine

A machine that mechanically mixes the Ball Sets and randomly selects the Winning Numbers each week.

Ball Sets

The Ball Draw Machine uses a set of numbered balls. Each ball has the exact same weight and size tolerances as the other balls in the set. Each week the balls are checked and validated by weight and size to ensure consistency.

Central Computer System

The Central Computer System contains the Raffle and Draw software that manages Emirates Draw and pays Prizes. It enables the Customer to enter into the Draw and manage their Account and winnings.

Claimant

A Customer who submits a claim to withdraw winning funds from their Winning Balance in accordance with these Rules.

Cookie Policy

The Emirates Draw Cookie Policy, a copy of which can be found on either the Emirates Draw Website or Mobile App.

Content

Any and all text, images, audio, video, scripts, code, software, databases and any other form of information capable of being stored on a computer that appears on, or forms part of, the Platform.

Credits

An amount held in the Wallet Balance to be used to Enter/Play the Game.

Customer, You or Your

A member of the public who intends to, or purchases, a Product and/or Service offered by Emirates Draw LLC.

Draw / Drawing

The process which results in the random selection of the Winning Numbers for a Draw using either a Random Number Generator (RNG) or a Ball Draw Machine managed by Emirates Draw.

Draw Manager

An employee of Emirates Draw whose responsibility it is to organise and manage each Draw.

Draw Procedures

A set of best practice procedures used to ensure each Draw is conducted in a fair and consistent manner, in line with any government requirements.

Emirates Draw

Emirates Draw LLC is a sustainable environmental support business that operates and manages Draws in the UAE.

Entry / Entries

A purchase which is recorded as an Entry on the Central Computer System. See Play.

Enter / Entering

Games To place an Order and participate in a specific week’s Draw.
Favourites A facility whereby a Customer may save their Favourite numbers for entering a Game in their Account.

Game

An Emirates Draw Game, the result of which is determined by either a Drawing through either an RNG or a Ball Draw Machine managed by Emirates Draw.

Government Representative

A government representative (or official), who may attend the Raffle and Ball Draws to witness that the Draws are conducted freely, transparently and fairly.

Grand Prize

Correctly matching all numbers in any one Entry against the Winning Numbers drawn by the Ball Draw Machine managed by Emirates Draw, according to the rules of that specific Game.

Immediate Family Members

With respectto any individual, such individual’s personal partner (including, without limitation, spouse and/or qualified domestic partner) and persons who are, to some extent, maintained by anyone mentioned in Rule 2.3 (d), (i) to (iii), in either case if living in the same household as that person.

Insurance Representative

A representative of the insurance company providing Grand Prize insurance (if required), who may perform independent verification of the Draw.

Legal Disclaimer

A written statement disclaiming all and any liability by the Owner and makes no assurances or promises about the quality or performance in respect of the Product and/or Service, and/or processes, and use or accessibility of the Platform. The Owner expressly denies any responsibility for any harm whatsoever resulting from Entering a Draw.

Manager, Owner, Our, We or Us

Emirates Draw LLC, a Limited Liability Company incorporated in the UAE, under Licence number 1019113.

Mobile App Emirates Draw’s

mobile phone application, which can be downloaded from the Apple App Store for iOS or the Google Play Store for Android.

Number Selection

The numbers that Customers choose as their Entry into a particular week’s Draw, according to the rules of that specific Game.

Order

An Order is made via the Platform and constitute an Entry into a particular week’s Draw.

Order Confirmation

An email sent to the Player confirming that an Entry has been accepted into a specific week’s Draw and forms a legally binding Contract between Emirates Draw and the Player.

Participant

The individual registered as the holder of the Account.
Password The alphanumeric and special character identifier used by a Customer to identify themselves when accessing their Account.
Platform The Emirates Draw Website and Mobile App and its associated Content.

Play A

purchase which is recorded as an Entry on the Central Computer System. See Entry

Player(s)

An Emirates Draw Customer who purchases a Product and/or Service and elects to enter the Game.

Privacy Policy

The Emirates Draw Privacy Policy, a copy of which can be found on either the Emirates Draw Website or Mobile App.

Prize A

Prize won by a Customer who enters and plays the Draw determined in accordance with these Rules.

Product/Service

An approved Emirates Draw Product and/or Service that is focused on the environment and available for the Customer to purchase online.

Quick Pick A

system feature whereby a set numbers are randomly selected for a Customer by the Central Computer System, in accordance with the rules of that specific Game.

Raffle

The Raffle is the first part of the Draw Game. Every Player who has entered that week’s Game will be entered into the Raffle, in accordance with the rules of that specific Game.

Random Number Generator (RNG)

A certified computer system that generates random numbers as a function of current value of some physical environment attribute. The function is constantly changing in a manner that is practically impossible to model.

Rules These Rules for Emirates Draw.
Sanctions List A global list of high-risk and sanctioned countries and individuals.

Syndicate

A group of Players who purchase Emirates Draw Products and/or Services and enter the Draw together with the intention of sharing any Prize in proportion to the contribution of each group member.
Syndicate Member A member of a group of Players who form a Syndicate.

Terms The Emirates Draw

Terms and Conditions, a copy of which can be found on the Emirates Draw Website or Mobile App.
UAE The United Arab Emirates.

Unutilised Credits

Unutilised Credits in the Wallet Balance, which have not been confirmed as Entries or Plays. If an Account is terminated, any Unutilised Credits will be forfeited, and no refunds made in accordance with UAE financial regulations.

Wallets
Emirates Draw has two electronic Wallets to manage Customer participation.

The Wallet Balance is where purchased Credits (1 credit is equivalent to AED 1) are stored for the Customer to enter future Games. Credits can be transferred to the Account by purchasing a Product online, or transferred from the Winning Balance.

A nominal charge of AED 1 may be applied to all accounts upon registration to cover the costs associated with managing this wallet.

The Winning Balance is where any winnings from the Raffle or Ball Draw are stored. Funds in this wallet can be transferred to the Wallet Balance to enter again, or once the balance in the Winning Balance wallet exceeds AED 200, can be withdrawn and paid directly to the Customer’s bank account or in cash (depending on the Customer’s circumstances and Emirates Draw Rules prevailing at the time.

Winning Numbers The numbers chosen through the Ball Draw Machine, all of which have been randomly selected at each Draw to determine the Prizes for that Ball Draw.
1.2 Unless the context otherwise requires, words in the singular shall include the plural and, in the plural, shall include the singular.

1.3 In the event of any conflict or inconsistency between the various documents set out above, the order of precedence is: (1) the Terms & Conditions; (2) the Rules; and (3) Privacy Policy

1.4 In the event of any conflict or inconsistency between the English and Arabic translations of these Rules, the English version of these Rules shall prevail to the extent of the inconsistency.

1.5 If there is any inconsistency between the instructions on the Platform or promotional and point of sale materials and/or advice and these Rules, these Rules shall prevail to the extent of the inconsistency.

Entering Games
2.1 Emirates Draws Products and/or Services will be available for purchase through the Platform at a cost set in accordance with the rules of that specific Game, or such other amount as We may, from time to time, determine.

2.2 Each purchased Emirates Draw Product and/or Service provides You with one complimentary Entry to the Draw.

2.3 You may only enter the Draw if You:

a) are at least 18 years of age at the time of purchase;

b) are not prohibited or restricted from entering under the laws of Your jurisdiction of residence or jurisdiction in which You are located when entering;

c) at all times abide by these Rules and the Terms & Conditions and Privacy Policy;

d) are not:

a Manager, employee or an Immediate Family Member of Emirates Draw
a Manager or employee of an affiliated company who are directly involved with the draw and related processes;
the Government Representative, the Insurance Representative or the Draw Manager;
a third party, contractor or consultant of the Manager engaged to review the insurance, audit and security procedures related to the Draw;
a resident of a sanctioned or embargoed country; or
named on a Sanctions List
2.4 Where You purchase an Emirates Draws Product and/or Service online via the Emirates Draw Website or Mobile App, upon purchase of the Emirates Draw Emirates Draw Pencil You will, after completion of the purchase, be asked to select a series of numbers, select a previously saved Favourite number or use the Quick Pick option.

2.5 Any “credits” held in the Wallet Balance can only be used to enter the Game(s). Credits can only be refunded to customers upon approval of Emirates Draw management, who will take into consideration prevailing UAE financial regulations.

2.6 All successful Entries will be acknowledged via email, in-Platform messages and where relevant, a push notification. Only receipt of this acknowledgement can be taken as confirmation of your entry into the currently Active draw. On rare occasions, the processing of payment requests via our Payment Service Providers may be delayed as a result of communication and network issues outside of our control. In these circumstances, your entries will only be entered into the Game(s) that are active at the time of payment approval in our records.

2.7 If You do not receive an acknowledgement of Your Entry, this may not have been recorded on the Central Computer System for the relevant Draw and therefore it may not be valid. In the event if You do not receive an acknowledgement, please check Your Account to see if Your Entry has been registered. If You cannot see it, please contact Emirates Draw’s Customer Service Centre on 800 7777 7777 (UAE) and +9714 356 2424 (Abroad) or by sending an email to customersupport@emiratesdraw.com.

2.8 Entries made on the day of the relevant Draw after 8:30pm UAE time, or such other time or day as We may determine, will not be entered into that Draw but will be entered in the next Draw.

2.9 There is no general right for a Customer to enter a Draw. We may refuse Entries and/or limit the number of Entries you can make without giving reason.

Draw
3.1 We will determine the time, frequency, date, and method of the Draw, in accordance with the rules of that specific Game.

3.2 Each Draw will be made using an internationally certified Random Number Generator and/or a Ball Draw Machine which will be audited at the time of the Draw.

3.3 All Draws will be conducted in accordance with the Emirates Draw’s Draw Procedures and in the presence of the Draw Manager, as well as an Insurance Representative and/or Government Representative. The Draw Manager and either the Insurance Representative or Government Representative will record in writing, and subsequently enter the Winning Numbers in the Central Computer System. Only these numbers will be the Winning Numbers for that Draw.

3.4 In the event of any Draw being declared invalid, in accordance with the Draw Procedures, another Draw will be conducted to determine the Winning Numbers.

3.5 In the event that a Draw does not take place or is interrupted due to equipment failure or for any other reason, the Draw will be completed in accordance with the Draw Procedures.

Results
4.1 All winnings from the Raffle and Ball Draw will be transferred to the Customer’s Winning Balance.

4.2 The Winning Numbers for each Draw will be made available on the Platform and through Emirates Draw’s Customer Service Centre as soon as practicable after each Draw. The Winning Numbers may be published in such manner as We may from time to time etermine. You will have no claim for compensation for any failure on Our part to publicise the Winning Numbers or for failure to notify holders of winning Entries.

4.3 You will not be entitled to claim for compensation, and We will not be bound by any errors contained in any announcement or publication, whether typographical, printing or otherwise or any publication or announcement of the amount of the Prizes in a Draw (where the announcement or publication is made before the amount to be paid in Prizes is finalised).

4.4 In the event of a discrepancy between the Winning Numbers published on the Platform and/or other announcement or publication and the official Winning Numbers contained on the Central Computer System, the latter shall prevail.

4.5 In the event that the final verified number of winning Entries is different than the initial publicised number of provisional winning Entries, the Prize money payable to such winners may vary.

Winning a Prize
5.1 Raffle Draw

a) There is one Prize category for each Draw.

b) For all entries in the Raffle Draw, the Number Selection will be automatically picked by an internationally certified RNG.

c) The number of winners and amount payable is in accordance with the rules of that specific Game.

d) Any winnings will be paid directly into Your Winning Balance.

5.2 Ball Draw

a) The Prize categories in each of this portion of the Drawing will be in accordance with the rules of that specific Game.

5.3 Customers that match numbers from the Winning Numbers drawn can win in both the Raffle Draw and in the Ball Draw.

5.4 In the Ball Draw, Customers can only win in one Prize category per single Entry but shall be entitled receive the Prize for the highest Prize category won (i.e., if You are a Match Five winner, You will only receive the Match Five Prize. You will not receive a Match Four, Match Three, Match Two and Match One Prize).

5.5 All Prizes will be rounded down to the nearest AED 1 (One Dirham).

5.6 All Prize winners will be notified by email, in-Platform messages and, where relevant, push notifications.

5.7 All winnings will be paid directly into Your Winning Balance.

5.8 For non-UAE national winners, federal and jurisdictional income taxes may apply to any monetary Prize.

5.9 At Our sole discretion, We may decide to pay out the Grand Prize winnings in a lump sum or in regular instalments or a combination of both.

Payment of Prizes
6.1 Prior to the payment of a Prize, the Customer may be validated according to Emirates Draw’s Customer validation procedures (KYC), including screening against the International Embargoed and Sanctions List. Our decision as to the validity of an Entry is final and binding.

6.2 In addition, prior to a Prize being paid, You may be required to provide:

6.2.1 full identification documentation; and/or

6.2.2 a statutory declaration as to ownership, entitlement and compliance with relevant laws.

6.3 We will only pay a Prize based on the official Winning Numbers of the relevant Draw recorded in line with Emirates Draw’s Rules and will not pay a Prize based on results recorded elsewhere.

6.4 Subject to verification of identity, proof of age and Entry validation:

6.5 The Grand Prize Prizes must be claimed in person in the UAE. Payment will be made (at Our discretion) by cheque or by bank transfer to a UAE bank account.

6.6 Payment of the Prize to the Claimant (or their authorised representative) shall fully and effectively discharge Emirates Draw, its officers, employees, representatives, contractors, any person or firm authorised by Us to pay Prizes, from any further liability for payment of that Prize.

6.7 We reserve the right to:

6.7.1 withhold a Prize until We are satisfied that an Entry is valid and/or the Claimant is lawfully entitled to payment of a Prize.

6.7.2 request proof of entitlement to a Prize (including, without limitation, identification information, proof of identity, residency or location when Entering Draws and capacity to claim).

6.7.3 invite a court to decide who a Prize should be paid to and/or make payment into court

6.7.4 declare an Entry invalid (and will not, therefore, be obliged to pay any Prize) if:

We reasonably believe that the Claimant is not the holder of the relevant Account, or that the information provided by the Claimant is incomplete or has been altered or tampered with.
the Entry has been tampered with in whole or in part or fails to pass our validation and security tests; or
the Entry is defective, in whole or in part.
6.8 We reserve the right to refuse and will not be liable to pay a Customer a Prize if:

the Customer does not meet the eligibility criteria or
You are unable or fail to supply the necessary identification documentation when claiming a Prize.
If a Prize is paid to anyone who does not meet such eligibility criteria, that person will be obliged to repay the Prize immediately upon Our request. We reserve the right to recover any incorrectly paid Prize.
6.9 We will not be responsible or liable to any person claiming a Prize which has been paid to a person who assumed the identity of the relevant Account holder.

6.10 Under no circumstances will interest be payable on any Prize.

6.11 Prizes will be paid in full only to the registered holder of the Account with the winning Entry, unless You are a person with a legal, physical or other disability and are claiming a Prize, where, in these circumstances, We may pay the Prize to Your authorized representative.

6.12 In the event of the death of a Claimant, a person can claim on behalf of such deceased Claimant’s estate where they can prove, to Our satisfaction, that they are entitled to make such a claim (for example, by providing a grant of probate ).

6.13 In the event of the death of an accepted and approved Winner, who had previously agreed a schedule of payments to receive their Prize, the payments shall continue to be paid, as per that agreed schedule, to their legal heirs and successors, once satisfactory evidence has been presented to and accepted by the company.

6.14 All cash Prizes will be paid in United Arab Emirates Dirhams in the amount advised by Us as the final amount payable for that winning Entry.

6.15 Due to anti-money laundering rules and regulations, The Grand Prize Prizes will only be paid into a UAE bank account (an Authorized Financial Institution can assist with account opening if required).

6.16 We disclaim any and all liability, including any express or implied warranties, whether oral or written to any Syndicate Members. By Entering Games, You acknowledge that no representation has been made by Us that We shall be responsible for or have any liability whatsoever for any purported claim from a Syndicate Member. For the avoidance of doubt, We will only be liable for any valid claim made by the registered holder of the Account with the winning Entry.

6.17 Where You Enter with the intent of sharing a Prize with Syndicate Members, You are:

6.17.1 deemed to be the Customer for the purposes of these Rules; and

6.17.2 are not acting as Our agent for that purpose, and We shall not be:

liable for the payment of any Prize to any Syndicate Member other than a Prize emanating from a winning Entry which is payable only to the registered holder of the Account with such winning Entry; and
bound by any agreement between the registered holder of the Account and any Syndicate Member.

Winners’ Information
7.1 By taking part in the  UAE LOTTERY Draw, You accept that We may disclose relevant personal details about You. We may also, if required by law or pursuant to the terms of Our Grand Prize insurance, provide a third party with Your details and the details of any Prize claimed by You or on Your behalf, or paid to You.Draw Postponement 8.1 If Emirates Draw deems it reasonable to do so, We may delay a Draw for as long as We believe it to be appropriate in the circumstances. In these instances, Customers will be permitted to Enter the Draw beyond the normal cut off times for that Draw.

9, Limitation of Liability
9.1 Our only obligation is to pay the Prizes won in any Draw to the rightful owners of winning Entries. We will not be liable in any circumstances for any loss of whatever nature other than the non-payment of a Prize to the rightful owners of winning Entries.

9.2 We shall not in any circumstances be liable for any loss, direct or consequential or damage incurred by any Customer or any other person arising from the participation by any person in the Draw. In particular, but without prejudice to the generality of this rule, We shall not be liable to any person for:

a) events beyond Our reasonable control and expectations (for example, without limitation, war, strike, lockout, industrial action, fire, flood, drought, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service);

b) the failure or destruction of, or damage to, all or part of the Central Computer System or Our records or any third party;

c) any mistakes caused by all or part of the Central Computer System or Our records or any third party;

d) delays, losses, mistakes or omissions in or made by the banking system;

e) any other action or event which prevents or hinders the issue of a valid Entry (including without limitation the failure of the Platform to display correctly on any device used to view it).

9.3 Nothing in these Rules excludes or limits (a) any person’s liability (i) for fraud; or (ii) for death or personal injury caused by breach of any duty that person may have to take reasonable care or exercise reasonable skill; or (b) any other liability which cannot legally be excluded or limited.

General
10.1 The reasonable exercise by Us of any discretion provided for by these Rules, including with respect of the determination of a winning Entry or payment of a Prize will be final and binding unless otherwise provided by law.

10.2 In the event that a dispute arises, We may withhold payment of a Prize and/or make an equivalent payment into court until it has been resolved.

10.3 If any provision (or part of a provision) in any of these Rules is decided by a court of competent jurisdiction to be void and/or unenforceable, that decision will only affect the particular provision (or part of the provision) and will not , in itself, make the other provisions void or unenforceable.

10.4 You may not assign or otherwise transfer (in whole or in part) Your rights and/or obligations under these Rules, including, for the avoidance of doubt, the right to a Prize. Any assignment or transfer by You will be null and void. We may assign or transfer Our rights and/or obligations under these Rules in whole or in part to any third party at Our sole discretion.

10.5 Except if We assign or transfer Our rights and/or obligations under these Rules, a person who is not a party to these Rules has no rights or otherwise to enforce any provision of these Rules.

10.6 We may amend these Rules from time to time. Such amendments, modifications or changes will be applicable and contractually binding with effect from the date of their publication on the Platform or on notification to You that changes have taken place, whichever is sooner and will apply to Entries made after the date on which the changes become effective, and/or Entries made before that date if reasonable in the circumstances. If We change these Rules You will be notified the next time You access Your Account.

Law
11.1 The relevant law for these Rules is the laws of the UAE and any legal proceedings will be heard in the UAE Courts.
